On general principles, contracts can be created in many different ways: orally, by exchange of emails, or by each party accepting a contract by the use of electronic signatures. So digital signatures can be used to create a binding contract. However, where the law imposes specific formalities on the making of contracts, such as contracts for the sale of land, digital signatures may not be appropriate and specific legal advice should be obtained.
