Associate Kelly primarily focuses on contentious probate. She is regularly instructed on behalf of beneficiaries, professional Trustees and executors on wide range of matters ranging from cases challenging the validity of wills, removal of executors to claims for financial provision under the Inheritance (Provision for Family and Dependants) Act 1975.

Matters Kelly has recently worked on:

  • Acted on behalf of a farmer in a claim based on proprietary estoppel on the basis he had worked on the farm all his life as a result of the promise made to him by his parents that the farm would be past to them upon their death, unfortunately, the will did not reflect this and his siblings would not agree to the farm land being passed over to him.
  • Acted on a matter whereby it was necessary to issue an application for the removal of an executor to an estate on the basis they were failing to co-operate with the co- executors resulting in a delay with the administration of the estate.
  • Successfully defended a matter where the beneficiaries applied for the removal of my client from dealing with the administration of her late father’s estate on the basis she had been acting inappropriately during the course of the administration.
